Marcilliat & Mills PLLC DEFENDS FELONY EMBEZZLEMENT CASE

(WILMINGTON, NC) – A North Carolina criminal defense attorney from Marcilliat & Mills PLLC, in Wilmington recently represented a man who was accused of stealing money from his employer. The client was facing a charge of felony embezzlement. Our defense lawyer, a graduate of the White Collar Criminal Defense College, was able to argue for a reduction of the financial criminal charge from a felony to a misdemeanor and avoid an active jail sentence for the client.

The client was accused of embezzling more than $20,000 from a church that employed him as a bookkeeper. A felony embezzlement conviction could have meant several months in jail.

After reviewing the evidence, it was clear to our defense lawyer that proper procedures were not put into place to prevent or bring attention to any financial wrongdoing at the church. Additionally, it was discovered that the church was made aware of its lack of sufficient oversight or checks and balances with its financial matters, but chose to take no steps to secure its own resources.

Our lawyer explained the personal factors at play in the alleged embezzlement that led to the questionable financial activity. The defense strategy was successful; the Assistant District Attorney (ADA) agreed to reduce the felony embezzlement charge to a misdemeanor. The client will only serve one year of unsupervised probation and must complete 48 hours of community service.
