So, what are the degrees of sexual exploitation of a minor?

  • First-degree sexual exploitation of a minor involves the production of child pornography. It is a Class C felony and carries a sentence of up to seven years in prison for a first-time offender.
  • Second-degree sexual exploitation of a minor means copying or distributing pornographic images of children. As a Class E felony, it may result in two to three years of prison time.
  • Finally, third-degree sexual exploitation of a minor is possession of explicit material depicting children. The penalty for this Class H felony is four to eight months in prison.
