Tax Avoidance Vs. Tax Evasion

It’s perfectly legal to minimize your tax burden through deductions, losses, tax credits, tax-deferred investments and other offsets. But certain practices are construed by the IRS or the North Carolina Department of Revenue as red flags for manipulating taxable income and evading tax payment.

The federal statute (U.S.C. § 7201) states: “Any person who willfully attempts in any manner to evade or defeat any tax imposed …” Under this broad definition, you could face criminal tax evasion charges for alleged actions such as:

· Underreporting income

· Hiding money in illegal tax shelters

· Diverting income or transferring assets to a third party

· Falsifying or destroying records

· Claiming phony or overstated deductions

· Claiming phantom or ineligible dependents

Tax evasion is a felony punishable by up to five years in prison and/or a fine of up to $100,000 (or $500,000 for a corporation), plus the costs of prosecution.

We Are Fighting For You

To convict someone for tax evasion or other tax fraud, the government must prove criminal intent. We work to show that what the prosecution sees as a “willful attempt” or tax avoidance scheme was an honest mistake, bad advice from a tax professional, or otherwise unintentional.
